THE CANARY ISLANDS AND THE INTERNATIONAL TREATIES*

In a few days Mr. Paulino Rivero Baute, current President of the Autonomous Government of Canary Islands, is going to move to Rabat, doing company to the Spanish government, in conversations of Spain with Morocco. Madrid is going to transport Mr. Paulino as invited of stone to these conversations, where in reality neither will puncture or cut but that it will go like figure since the conversations are between the monarchic governments of Spain and Morocco. If Mr. Paulino Rivero likes this role, is his question but that it knows that there only will be agreements in the future with Morocco, when we have reached our Sovereignty and not before. Taking advantage of this trip, we remember to Mr. Rivero, the Draft of our future Constitution of our Federal Canary Republic, presented by the CNC, where is anticipated our foreign policy, by if you do not know it, and that we hope that serves of base for after the year 2.010, that is there close and it is where peacefully, we suppose, we will reach our sovereignty according to the mandate of the United Nations. So, read it Mr. Paulino, because this Draft has been published in the independent newspaper of Tenerife, ¨El Día¨, during six months and you has read it, as all the readers.
Article 121).- Of International Treaties.
The Government of the Federal Republic will communicate, once constituted legally, to the Secretary of the United Nations its intention to enter to form part, being a Free and Sovereign State, of said International Organism, compromiting itself to respect the Letter of the United Nations and all the international agreements of the United Nations and all the approved international conventions. At the same time it will communicate to this Organism, that is a constitutional principle of the Canary Federal Republic, the defense of a politics of Positive Neutrality and that we request to all the States of the U.N. that respect this constitutional principle of our Republic.
Article 122).- All the agreements subscribed by Spain, that affect to our Republic and its territory, are nulls of full right since the day of the Independence. The commercial or monetary agreements that affect the Canary Islands are nulls of full right and they should be revised and signed other news with the parts that be interested.
Military agreements with any International like NATO will not be signed neither other that affect at the beginning of Positive Neutrality of the Nation. With the African neighboring countries we will be able to sign pacts of friendship, respect of borders and not aggression, if they have been subscribed and approved by the respective Legislative National Assemblies.
Article 123).- So that the Federal Republic will be forced to respect and to be compromised with International Treaties, these treaties must be approved obligatorily by the Legislative National Assembly by the two thirds of their members and if they refer to rights and obligations of canary citizens resident in third parties countries, they will have also, obligatorily, include the approval of the Senate by simple majority.
These treaties will never go against the Constitution or against some of their clauses or against the integrity of the Nation and its borders or against another African state. In signed International Treaties a clause will be always included by which the parts are commited to solve their divergences by the pacific routes accepted internationally or previously agreeded by the parts.
The International treaties that the Government celebrates and approves the ANL will have to be approved by a Special Law so that they have validity, and if did not were improper, a clause will be incorporated according to which the doubts and differences that can arise between these contracts and that did not get to be solved in a friendly way by the contracting parts, they will be decided by the competent Courts of the Republic, in conformity with his laws, without by no reason or cause they can give origin to later foreign claims.
Article 124).- The International Treaties, once approved according to the previous article and published in the Official Bulletin of the Republic, will be sent to the Secretariat of the United Nations and, from that moment, they will form part of the public code of the Nation; copies of the same will be sent to the governments with who we maintain diplomatic relations
Art. 125).-. The relations with the European Union will have to be established in base to the respect of our sovereignty and of our Principles of Positive Neutrality. The Government will establish preferential agreements as interested third country, or well with certain European countries or well with all of the EU. Canary Islands has had in its history, cultural and traditional economic relations of commerce with certain European countries, or with the old metropolis, reason why it will be able to establish particular commercial or cultural agreements in common agreement and in mutual benefit.
